An Air Force One Boeing 747 trailed by two fighter jets swooping low in the sky over New York triggers fears of a nightmarish September 11 replay.

The planes circled the Statue of Liberty and flew close to the World Trade Center site as part of a government photo op at 10 am on Monday morning.

The half-hour exercise, which was conducted without any notification to the public, panicked workers in some areas and forced evacuations at scores of buildings in Lower Manhattan and Jersey City.

The event was reportedly intended to update a stock photo of the presidential plane for distribution to the media.

The photo shoot also prompted an outcry among US officials with New York Mayor Michael Bloomberg saying it was "insensitive" to fly so near the site of the Sept. 11, 2001, attacks.

"Why the Defense Department wanted to do a photo op right around the site of the World Trade Center catastrophe defies the imagination," Bloomberg said. "Poor judgment would be a nice way to phrase it. ... Had I known about it, I would have called them right away and asked them not to."

According to an unnamed White House official, President Barack Obama was "furious" when he learned of the incident later in the day.

Following the outrage over the photo opportunity gone bad, director of the White House Military Office Louis Caldera shouldered the blame, saying he approved the mission last week.

"I take responsibility for that decision," Caldera said in a statement. "While federal authorities took the proper steps to notify state and local authorities in New York and New Jersey, it's clear that the mission created confusion and disruption. I apologize and take responsibility for any distress that flight caused."

New York officials, incensed at the event, questioned the Federal Aviation Administration's motivation for ordering local officials, including the New York Police Department, not to alert the public in advance.

An FAA memo last week said information about the exercise "should only be shared with persons with a need to know" and "shall not be released to the public or the media."

Under federal regulations, in urban areas, airplanes must fly at least 1,000 feet above obstructions like buildings and bridges, and jetliner flights over Manhattan are typically conducted at 8,000 feet or more.

According to witnesses, as the planes swooped by office towers in the area, they were close enough to rattle the windows.

Mr. Phillips failed to adequately supervise subordinate attorneys and non-lawyer specialists.

Specifically, intake personnel failed to affirmatively identify themselves as non-attorneys and failed to affirmatively offer or provide adequate information concerning limitationson the applicability of Mr. Phillips’ firm’sadvertised “little or no money down” payment plans.

The Disciplinary Commission found two aggravating factors pursuant to the ABA Standards for Imposing Lawyer Sanctions, Section 9.22: (c) pattern of misconduct and (d) multiple offenses.

The Disciplinary Commission found five mitigating factors pursuant to Section 9.32 of the ABA Standards: (a) absence of prior disciplinary history, (b) absence of selfish or dishonest motive, (d) timely good faith effort to make restitution orto rectify consequences of misconduct, (e) fulland free disclosure to disciplinary board orcooperative attitude towards proceedings and (l) remorse.

Mr. Phillips’ conduct violated Rule 42,ARIZ.R.S.CT., specifically ERs 5.1, 5.3 and7.1.

SAN DIEGO (CN) - A former attorney for the Pacific Law Center, a champion for conservative issues, says the center "routinely commits malpractice," charges unearned fees and "takes legal action detrimental to clients."

The center "is an unlawful 'front' organization created by defendants Larry Majors, Austin Majors, and Jeffrey Phillips to permit them to engage in and profit from the unauthorized practice of law," one of their former attorneys says in Superior Court.

Carl Hancock says the La Jolla-based defendants "routinely commit malpractice in the handling of legal matters," churn legal fees, "take legal actions which are detrimental to the clients," charge excessive and unearned fees, and that Larry Majors is a felon whose conviction bars him from practicing law in California, and who fled from Texas "when faced with prosecution for the unauthorized practice of law." Hancock says he worked for the defendants from March 11, 2007 until Jan. 19, 2008, and that he was fired for repeatedly protesting their unethical and illegal behavior.

He describes the PLC as a fraudulent conspiracy that defrauds clients to unjustly enrich themselves, that the Majorses and Phillips, oversee the work of defendant "front" attorneys Alan E. Spears, Thomas Slattery and Kerry Steigerwalt, and that they fraudulently conveyed assets of the PLC to Steigerwalt, to duck liability.

Neither Larry Majors, Austin Majors or Jeffrey Phillips is an attorney, Hancock says. Austin Majors is Larry Majors' son, and Phillips is Larry Majors' son in law, he says.

The complaint continues: "Larry Majors suffered a felony conviction in the State of Arizona and which precludes him from becoming eligible to practice of law in the State of California. Plaintiff is informed and believes that Larry Majors, while residing in the State of Texas, engaged in schemes similar to those described herein and fled the jurisdiction when faced with prosecution for the unlawful practice of law."

Hancock describes Spears as "one of the 'front' attorneys who permit the other non-attorney Defendants to control the firm. Spears has actual knowledge of the firm's true ownership and control yet, in violation of the legal and ethical duties imposed on him by his membership in the Bar, continues to permit the non-attorney to make client decisions and profit from the unauthorized practice of law."

Hancock describes Slattery in similar or identical terms, and adds, "Defendant Slattery boasts privately of having 18 State Bar complaints filed against him, however, the firm has never disciplined Slattery for any complaint."

He claims defendant Christopher Castle is not an attorney authorized to practice in California, and that "Castle's role in the conspiracy is to manage and supervise the 'Intake Coordinators,' the firm's legal salesmen, who are instructed to extract as high an amount of attorney fees as the client will agree to bear. Castle's actions are controlled, directly and indirectly, by Defendants Larry Majors, Austin Majors, and Jeffery Phillips. The attorney 'front-men,' Spears and Slattery, operate under specific instruction from Defendant Phillips to exert no control or authority over Castle or the salesmen."

Hancock says defendant Michael Wilkes is not an attorney authorized to practice in California, and that "Wilkes' role in the conspiracy is to act as one of the firm's salesmen. Clients have repeatedly complained that Wilkes holds himself out to be an attorney and gives legal advice, yet the firm has never disciplined him for such activities."

And he says Stiegerwalt is an attorney who "knew or reasonably should have known of the unlawful and ethical activities undertaken by each of Defendant (sic). Steigerwalt's role in the conspiracy consisted of entering into a sham sales transaction for the purpose of protecting the assets of each other Defendant in the event of liability under this complaint."

He claims that the Pacific Law Center "is controlled by Defendants, and each of them, for the purpose of avoiding California state laws prohibiting fraud, theft, and the unauthorized practice of law." He claims they "routinely engages in fraud in the solicitation and retention of prospective clients." He claims the "non-attorney 'Intake Coordinators' ... routinely provide unauthorized legal advice and use 'high-pressure' and 'scare' tactics to induce clients to retain the firm."

He claims, "The actions and tactics of the non-attorney 'Intake Coordinators' are controlled, directly and indirectly, by Defendants Larry Majors, Austin Majors, and Jeffrey Phillips, who employ unskilled attorneys to act as 'front-men' for the firm. These 'front' attorney have no authority to act on their own." He claims they "extract excessive and unconscionable fees and that clients are not informed about the work to be undertaken until after their retention." He claims that "Although the firm publishes an in-house 'fee schedule' for the benefit of State Bar investigators, the firms' salesmen quote excessively inflates fees dictated only by the client's assent. ... In many case, the salesmen obtain and hold the prospective client's driver's license or identification card to prevent the client from leaving the premises."

He claims "that Defendants and their agents routinely make misrepresentations to the State bar and other public and non-public entities for the purpose of hiding or 'covering-up' Defendants' illegal activities."

He claims that he witnessed this while he worked for the Pacific Law Center, and that his bosses there "directed Plaintiff to perform frivolous and unnecessary legal work for the purpose of obtaining unearned legal fees in violation of the public policies prohibiting fraud and theft," and that "as a result of Defendants' repeated demands to engage in activities in violation of public policy, Plaintiff was constructively terminated from his employment."

Hancock, who filed the complaint pro se, demands an injunction and punitive damages for conspiracy to engage in unauthorized practice of law, constructive discharge, fraud in the inducement, unjust enrichment, and asks the court to set aside fraudulent conveyance.

LAWYERS Lawyer referral service targeted State eyes allegations one law firm gets most of business By Kym Fox Express-News Staff Writer

A lawyer referral service operating in San Antonio has come under scrutiny by state authorities amid allegations that one law firm is getting most of the business.

The law firm has disavowed any relationship with the referral service other than that of a subscriber.

The executive director of the three-lawyer firm, however, has been identified as the person who placed ads for the referral service.

South Texas Lawyers Referral Service has been running ads on television and in newspapers in San Antonio since the spring.

The ads offer "free help to locate and hire the appropriate attorney." It promotes a 24-hour telephone number for those looking for a lawyer to handle everything from divorce or personal injury to IRS problems and bail bonds.

"The lawyer you choose will make a difference" the newspaper ad reads.

But callers to the referral service are given little choice.

During the past week, San Antonio Express-News reporters called the referral service 14 times asking to be referred to lawyers who could handle everything from parrot smuggling charges in federal court to divorce and copyright laws. Of the 14 calls, 12 resulted in referrals to the law firm of Davis and Associates.

On two occasions when the name of a second lawyer was requested, the referral service operators said: "We only refer to Davis and Associates."

The referral service gave out another lawyer's name for immigration cases, and suggested noted personal injury lawyer Pat Maloney when asked about workers compensation cases.

Maloney said he has never heard of the referral service, and did not give permission for the use of his name.

"That would be a rather scurrilous misrepresentation," Maloney said, condemning the referral service.

Maloney also said his firm no longer does workers compensation cases because of changes in the law, nor do most other firms.

Authorities at the State Bar of Texas, the state agency that licenses and polices lawyers, are looking into the San Antonio referral service, but said there is no formal investigation of it.

"As far as an investigation, we're looking into it, but I can't comment on it any further," said Jim McCormack, general counsel for the state bar.

"We're aware of that service," McCormack said. "If there is any referral service not in compliance with the law, we're going to look at it."

McCormack said that, for now, his agency is concentrating on shutting down a similar operation in the Fort Worth area called Texas Lawyers Referral Service. In San Antonio

In San Antonio, lawyer Marvin Davis is the owner of Davis and Associates. Working with Davis at the firm are lawyers Frank Taylor and Robert A. Forester. Davis employs Larry Majors, who is not a lawyer, as executive director of the firm.

Davis said his firm subscribes to the referral service but is not otherwise connected. Davis said he does not know who owns or runs the referral service.

"We're not affiliated, we're a member," he said.

Majors also denied knowing who owns or runs the referral service. An advertising representative said, however, that Majors was the one who placed ads for the service earlier this year and that the ad orders were picked up at the offices of Davis and Associates.

Davis said he was unaware that his was the only firm offered for referral in most instances.

Davis suggested the referral service surely would not send clients seeking help with traffic tickets or copyright law to his firm because he does not handle such cases.

When contacted about such cases, however, the referral service again suggested Davis and Associates.

Davis said he was perplexed.

"Somebody ought to straighten them out, and I will take what steps I can," he said.

The law firm may drop the use of the referral operation soon anyway because it is generating too much business, Majors said.

"We are probably going to pull out after this month," Majors said. "It's too time consuming to talk to all the clients."

Majors went on to speculate that the loss of the Davis and Associates business could force the referral service out of business.

"It's probably going to drive them out of San Antonio," he said.

Records at the Secretary of State's office in Austin show the referral service was incorporated April 6 by Vern Brand, with Edith Brand of Arlington as a registered agent.

At the San Antonio Bar Association, Executive Director Jimmy Allison said his office has received complaints about South Texas Lawyers Referral Service.

Allison said he could not discuss the specifics of the complaints, but said the bar association also has placed calls to the referral service and been referred almost exclusively to Davis and Associates.

"In the calls, everyone has been referred to them," Allison said. "There were 10 or 12, we called for family law, for criminal, securities law, environmental law we covered the gamut, probate law."

The Vernon Civil Statutes contain the law governing lawyer referral services. They must be non-profit and meet a number of criteria. A provision of the law limits to $20 the fee that a lawyer can charge for the first 30-minute consultation for a client referred through such a service.

The San Antonio Bar Association runs its own referral service, one that is sanctioned by the State Bar of Texas. It carries hundreds of lawyers, who pay $100 each to be listed in their area of expertise, Allison said.

"If you run a referral service, it's got to be a public service," Allison said. "We lose money off ours."

Lebanon's army arrests two Mossad spies in Bekaa valley.

The Lebanese army has placed two men under arrest after discovering a spy network operating for the Israeli intelligence agency, Mossad.

According to an army statement, the two men whose nationality has not been disclosed 'belonged to a terrorism and spy network involved in dealings with the Israeli enemy.'

High-tech cameras and communication devices, in possession of the two suspects, were also confiscated during the arrest, the statement added.

The army said the pair had confessed to monitoring party officials and centers.

A report by the Lebanese daily As-Safir quoted judicial and security sources as saying that one of the two men is the network's leader who was arrested in the Western Bekaa valley after monitoring his activities in Lebanon and his trips between Lebanon and Syria during security developments in the region.

Sources close to the investigation said Mossad recruited the suspect in the 1980s, adding that the other detainee is the leader's relative, who has confessed to monitoring the activities of personalities and convoys as well as observing sensitive sites particularly in central Bekaa.

The probe will investigate the networks role during the 33-day war Israel waged on the country in the summer of 2006.

This is not the first time that the Lebanese army makes arrests on suspicion of intelligence ties with Israel.

In June 2006, the Lebanese army detained Mahmoud Rafeh in connection with a car bombing which resulted in the death of senior Islamic Jihad official Mahmoud Majzoub and his brother in front of their home in the southern city of Sidon.

Rafeh later confessed to involvement in the Majzoub assassination plot as well as other operations, including a bombing in August 1999 which led to the death of Hezbollah official Ali Dib.

(WMR) -- One of the over 120 Israeli "art students" who cased federal office buildings and military bases during a year and a half before the 9/11 attacks has revealed details of her "assignment" in the United States to a WMR source.

The former art student, who is now assigned to work with a non-governmental organization (NGO) in South Africa on research on violent crime against South African whites by blacks, said she was first assigned to work at an Israeli-owned shopping mall kiosk in Orange County, California, in early 2001 to "brush up on her American English language skills."

From California the young Israeli woman was transferred to Chicago and then to Houston, where she worked in an office close to the sprawling port facility. Her "cover" was as an accountant for an Israeli intelligence front company involved in the shipping business. It should be noted that former CIA Southeast Region Station Chief Roland V. Carnaby, shot to death on April 29 by two Houston police officers, was known to have been concerned about the lack of security at the port of Houston, was monitoring the activities of Israeli intelligence in the greater Houston area, and was known to have clashed with the Department of Homeland Security over its lack of interest in providing security for the Port of Houston.

After her stint in Houston, the Israeli art student was transferred to New York City for a two-week "holiday." However, she and her group were ordered by their superiors to be "out of the city" on September 11, 2001.

The Israeli woman was granted access to the United States on a student visa and she was identified as an "art student" in her visa application. It was later discovered that none of the Israeli "art students" were, in fact, art students. Those detained as a result of a joint investigation by the Drug Enforcement Administration (DEA), the Marshal's Service, and other federal law enforcement agencies were simply deported to Israel without facing a trial for wrongly stating their purpose for coming to the United States.

The Israeli "art student" also claimed that while working at mall kiosks in California she was "working on other things."

Sixty-one years after he was buried at a windy hilltop cemetery in Southeast Washington, Stephen Theodore Norman, the only grandchild of Zionism's founder, was exhumed yesterday after a five-year campaign to have him buried near his family in Israel.

As morticians in plastic jumpsuits sifted with their gloved hands through mud and water in the five-foot grave crater, Jerry Klinger stood alongside. Klinger, a passionate Jewish history buff from Rockville, was watching the realization of years of intense -- and often ignored -- lobbying for what he sees as a battle for the legacy of Theodor Herzl and the Zionist movement Herzl founded more than a century ago in Europe.

After thousands of e-mails, letters, visits with Israel's top politicians and rabbis, and other efforts -- even commissioning research on the mental health of Herzl and his offspring -- Klinger is seeing his dream come true. The remains of Norman, Herzl's only descendant to embrace Zionism, will be flown Monday night to Israel. He will be buried Wednesday on Mount Herzl in Jerusalem, with top national officials taking part.

Mount Herzl, where Norman's grandfather is buried, is akin to a smaller version of Arlington National Cemetery; such Israeli giants as Golda Meir and Yitzhak Rabin are buried there.

"His family represented the idea of a better world for millions of people -- not just Jews, for the world," said Klinger, 59, looking out at the graves at Adas Israel Cemetery on Alabama Avenue, many of which date to the 1800s. "And he was just buried there and forgotten."

Herzl is among Israel's most famous names. Every town has a Herzl street. There is a city named after him. His face is on the Israeli currency. But the name also is linked to a series of family tragedies.

Historians of Israel and modern Jewish history say Herzl's goal -- finding Jews an escape from murderous European anti-Semitism -- and his philosophy have simply faded to the background as time has passed and Israel's contemporary conflicts have come to the fore. Herzl, who died 44 years before Israel's establishment, envisioned a utopian, egalitarian society and peaceful relations between Arabs and Jews. But by 1975, the U.N. General Assembly passed a resolution calling Zionism a form of racism. The resolution was rescinded in 1991, but advocates of Israel worry that the stigma will never disappear.

Herzl's name has also been attached to great tragedy in his family. The Hungarian-born journalist died at 44. His elder daughter suffered from mental illness and apparently died of a drug overdose. Her brother, who had converted to Christianity, committed suicide when he learned of her death. Herzl's younger daughter, who was in and out of mental institutions, was the only one to have a child -- Stephen Norman, who became a captain in the British Army and was posted to the embassy in Washington in 1946.

Several months before, he visited Palestine, the only member of his family to go there. Norman wrote in his journal from the trip that he "believed in the idea and the aims of Zionism, and in the moral, ethical, economic, and social need for it that had been made even more urgent and important by world events and the tremendous problems created by the new scientific anti-Semitism of the last decades."

Commenting on the children he saw in Palestine, he wrote: "I thought of their little brothers and sisters who had not been allowed to play in German streets, and it was good to see these free Jewish children. . . . I thought of the dark, sallow, unhappy Jewish children of Europe. I had seen pictures of their faces; their youthful frames had borne the features of old men and women, and now I saw these little ones who look like children again."

Soon after arriving in Washington, Norman learned that his parents had been killed in a Nazi concentration camp. At 28, he plunged to his death off a Massachusetts Avenue NW bridge.

Herzl was not a towering figure at the time of Norman's death, and, with no relatives, Norman was buried in the Adas Israel Cemetery without even a headstone. Two years later, synagogue members provided one, which stood in a corner of the cemetery yesterday, abutting a chain-link fence.

A tiny crew attended the disinterment, including Klinger, in a black velvet yarmulke, three morticians, an Israeli journalist, a cemetery employee operating a backhoe and Carrie Devorah, a photojournalist who has been helping Klinger with his campaign.

"His grandfather is what anchors us [Jews] in the world," Devorah said, gesturing to a metal box in which the morticians were placing Norman's bone fragments and wood from the disintegrated coffin they had found in the mud. "When people say, 'Go home,' we have a place to go. Before, we had nowhere to go."

Historians and others still sift through Herzl's writings and see many legacies. They note that he envisioned a Jewish state where people spoke not Hebrew, but German; that he and other early Zionists failed to understand Arab nationalism; and that in a utopian novel Herzl wrote, he describes a binational, egalitarian state.

"It's complex, not simple," said S. Ilan Troen, an Israeli studies professor at Brandeis University. "You could say, 'Who is your Herzl?' And you get different answers."

Despite Herzl's prominence, getting Norman exhumed and moved to Jerusalem was not easy. American Jewish and Israeli leaders weren't convinced of his prominence, and they were focused for several years on getting Herzl's two children moved from their graves in France (the remains of a third, Norman's mother, were never found) to Israel, a request Herzl made before he died. Jewish law also forbids suicide and the burying of people who commit suicide in Jewish cemeteries. Klinger had to commission research at the behest of Israel's chief rabbi to prove that Norman was ill, a distinction that has gained acceptance, but not among some Orthodox rabbis.

To achieve his goal, Klinger needed various approvals, including those of Adas Israel (which owns the cemetery) and the D.C. Department of Health. At Klinger's request, the Israeli Embassy signed the request to the city.

Klinger, an investment adviser, was advocating from a position of relative obscurity. He wasn't a relative of Herzl and wasn't joined by any of the large U.S. Jewish organizations. He petitioned the Israeli government through the small group he runs, the Jewish American Society for Historic Preservation.

"It wasn't sort of an obvious thing. Herzl didn't actually know [Norman]; it was a longer shot," said Jacob Dellal, spokesman for the Jewish Agency-World Zionist Organization, which represented Jews before the founding of the state. The group still shares jurisdiction over some state entities, including Mount Herzl.

Until Norman is buried in Israel, he is being handled as though he had just died. His remains were driven in a hearse yesterday to a Rockville funeral home, where a shomer, or guard, is reading psalms beside him, as is customary for the Jewish dead. At 10 a.m. Monday, there will be a funeral service for him at Adas Israel, in Northwest Washington. And then he will head to Israel.

Report: Kodak Experts Say Beheading And Torture Video Taken With Same Camera!

REPORT: KODAK EXPERTS SAY BEHEADING AND TORTURE VIDEO TAKEN WITH SAME CAMERA!

THE HAL TURNER SHOW HAS RECEIVED A REPORT WHICH SAYS THE NICHOLAS BERG BEHEADING VIDEO WAS TAKEN WITH THE SAME DIGITAL CAMERA AS THE ABU GHRAIB PRISON TORTURE VIDEOS!

Apparently, digital camera manufacturers install a "digital watermark" on each digital imaging device, which is as unique as a fingerprint. Experts have reportedly analyzed the videos and compared the digital watermarks and determined that the same imging device took the Nicholas Berg beheading video and the Prison torture videos!

The exact text of the report is as follows:

Today new pictures were released of prison torture at Abu Ghraib prison.

But not just still pictures. Today video was released showing prisoners being tortured by Americans.

Aparently Kodak film experts at Kodak Park in Rochester New York have compared the digital watermarks of the torture video and the beheading video and have determined that one of the cameras used in the Nick Berg beheading is THE SAME CAMERA that took the prison torture video.
